Court Denies Bail to Developer in Money Laundering Case

The Punjab and Haryana High Court recently dismissed the regular bail plea of prominent real estate developer Jarnail Singh Bajwa. Facing severe scrutiny from the Enforcement Directorate (ED), the Managing Director of Bajwa Developers Limited remains behind bars.

Justice Manisha Batra noted that initial allegations present clear grounds linking the developer to serious predicate offenses under the Prevention of Money Laundering Act (PMLA). Legal proceedings continue to expose deep financial discrepancies within the corporate structure.

Understanding the Allegations and Financial Diversion

Investigators uncovered that Bajwa systematically accumulated approximately Rs. 662.49 crore from trusting homebuyers. Victims were promised timely possessions of plots, flats, and commercial spaces that ultimately lacked valid statutory approvals (1.1.1).

Instead of channeling these substantial funds into project development, the developer allegedly diverted resources toward personal and unrelated corporate gains. Authorities tracking the financial trail discovered purchases of luxury vehicles, new land parcels, and the clearance of family debts (1.1.1).

The Scope of Consumer Fraud and Legal Obstruction

As many as 41 distinct First Information Reports (FIRs) were filed by disgruntled customers. These complaints highlighted rampant issues including multiple sales of identical plots and severe contractual cheating.

Legal counsel representing the Enforcement Directorate argued that the defense actively hindered the active investigation. By withholding authentic ledger data and supplying conflicting financial figures, the accused compounded his legal jeopardy (1.1.1).

Statutory Presumption and the Court Ruling

The High Court underscored that the defense failed to rebut Section 24 of the PMLA. This statutory section automatically links seized assets directly to unlawful money laundering activities.
